VR sells clearing service to an orderer whose rolling stock has participated in accident or a damage situation.
The term ‘accident’ refers to a railway accident which, on the railway, causes damage or direct danger to humans, property or environment and which requires rescue and clearing measures (Finnish Transport Agency's guide about getting prepared for railway accidents (5/2016)). The term ‘damage situation’ refers to a situation where railway rolling stock has been derailed.
VR sells clearing service on VR's private tracks and, by request, also on other track sections based on the clearing managers and units of Helsinki, Tampere, Kouvola, Pieksamäki and Oulu being on-call and carrying out clearing.
VR's clearing activity is organised into 5 regional operating units, each of which has a clearing manager in charge of the activity and on-call 7/24. The crew is assembled according to the task in question.
The operations are based on permanent on-call monitoring, maintenance of the crew's skills as well as on suitable ready-to-go equipment and technical transfer and lifting equipment.
The orderer must supply VR with a special equipment suitable for the rolling stock and clearing, which is not included into VR's own clearing equipment.
The services are delivered on assignment by the orderer. The assignment is created when the contact person informs VR about the clearing need, when VR is informed about the clearing need by the traffic control or it is obvious that the accident or damage situation requires immediate clearing aid from VR.
The orderer gives the contact details (24/7) to communicate about possible questions with the owner of the rolling stock related to the clearing operation, including carrying out transfers or demanding lifting operations.
The service includes the measures which include clearing of the place and moving the railway rolling stock as much as it is necessary to get the railway in condition for the traffic.
The person managing VR's operations in the place of the accident has the right, in each case, determine the resources that are to be alerted for carrying out the clearing measure.
A fixed charge in an accident or damage situation: €8,400 with VAT of 0%
Additionally, there will be a charge for costs realised in an accident or damage situation which consists of:
- hours spent (€47.5, VAT 0%, based on the currently valid hourly charge for clearing work.)
- material costs
- as well as other needed third-party services, including the lifting work and machinery
The pricing will be reviewed annually. The updated prices based on clearings performed in 2016 will be published during March.
The invoicing in accordance with clearings performed (case by case).
When the agreement is being drawn up, the orderer will deliver to VR the technical material concerning its rolling stock and traffic and needed in carrying out the clearing activity as determined by VR and arrange an opportunity for VR to familiarise with the rolling stock.
VR has the right to request additional technical explanations about the rolling stock.
The orderer and VR will agree on the extent of the preliminary activities. The evaluation will take into account, among other things, the type of rolling stock, the way the rolling stock is to be used and the area for the traffic.
VR inspects the suitability of the rolling stock for clearing activities on the basis of the documentation provided by the orderer. Also, the existence of aiding and support tools will be checked.
VR will familiarise itself with the details of the rolling stock. Based on VR's justified opinions, agreements on necessary supplementations to the documentation or devices will be made.
Annual clearing agreements are always made with the orderer. The orderer undertakes to pay for VR’s on-call clearing activity and for carrying out the clearing operation in accordance with the pricing list that is currently valid.
VR will not be liable if the rolling stock or clearing equipment suffer additional damage that arises as a consequence of VR's operations in accordance with the agreement (e.g., when the equipment is being lifted or moved). VR's potential liability is limited, in each case, to the price charged for the service provided, and VR is not liable for indirect damage.
